Falls are the single leading cause of death in construction, year after year — and fall protection is perennially OSHA's most-cited standard overall. The rule isn't complicated; the discipline of applying it on a changing jobsite is. Here's the shape of Subpart M.

The six-foot trigger

Under 29 CFR 1926 Subpart M, construction workers on a walking/working surface with an unprotected side or edge six feet or more above a lower level must be protected from falling. (Note the contrast with general industry, where the trigger under 1910 Subpart D is generally four feet — the height depends on which world you're in.) Separate provisions cover holes, leading edges, excavations, roofing, and wall openings.

The three conventional methods

For most exposures, Subpart M gives you three conventional options, and you pick what fits the work:

  • Guardrail systems — a toprail around 42 inches, a midrail, and the ability to withstand a 200-pound force.
  • Safety net systems — installed as close as practicable under the work, never more than 30 feet below.
  • Personal fall arrest systems (PFAS) — a full-body harness, a connector, and an anchorage, rigged so a worker can't free-fall more than six feet or hit a lower level. Body belts for fall arrest are prohibited.

Certain activities (leading-edge work, residential construction, and others) allow specific alternatives, and where an employer can show conventional methods are infeasible or create a greater hazard, a written fall protection plan may apply.

Anchorage and system details matter

A personal fall arrest system is only as good as what it's tied to. Anchorages used for attachment must support the required load per worker, and the whole system has to be inspected before each use for wear, damage, and deterioration. A harness in a gang box for two years is not a control until someone confirms it's still sound.

Training is not optional

Subpart M requires a training program by a competent person for every employee who might be exposed to fall hazards. Workers have to be able to recognize the hazards and know the procedures to minimize them. And when there's reason to believe a worker lacks the understanding — new hazards, changes on site, or evidence of gaps — retraining is required. Employers must keep a written certification record of who was trained and when.

Where it slips on a real jobsite

Fall protection fails less on the standard and more on the churn of the site: an anchor point that moved, a harness that never got inspected, a new subcontractor crew whose training you can't quickly verify, a leading edge that changed since this morning. Those are records-and-verification gaps.
